Company formation in Malta is a regulated process delivered by an MFSA-licensed entity. Equitrust Group operates under the full AML and KYC framework required by the Malta Financial Services Authority, the Financial Intelligence Analysis Unit (FIAU), and applicable EU anti-money laundering directives. Compliance is not an administrative step. It is the reason our clients’ structures withstand scrutiny from European regulators, institutional counterparties, and banking partners.
Malta operates within the EU’s Fourth and Fifth Anti-Money Laundering Directives. Every client onboarding includes identity verification for all directors, shareholders, and beneficial owners, source of funds documentation, an Ultimate Beneficial Owner declaration filed with the Malta Business Registry, and ongoing monitoring proportionate to the risk profile of the engagement. Higher-risk profiles, including complex ownership chains, high-risk jurisdictions, and politically exposed persons, receive enhanced due diligence before any application is filed with the MBR or any regulatory authority.
We do not incorporate structures we cannot explain. If your business plan, ownership structure, or source of funds raises questions we cannot resolve through standard due diligence, we tell you before any engagement begins. A file that cannot be documented cleanly does not proceed.
No structure is submitted to the Malta Business Registry without a complete, documented, and verified KYC file. Our compliance obligations extend beyond incorporation. We monitor regulatory updates from the MFSA, the FIAU, and the EU’s AML framework, review client files at defined intervals, and report suspicious activity in accordance with Maltese law and FIAU reporting obligations. All client records are retained for a minimum of five years from the end of the business relationship, in line with Maltese AML legislation.
Malta’s FATF standing is clean. The jurisdiction exited the FATF grey list in June 2022 following a comprehensive reform of its AML/CFT framework. Structures incorporated in Malta today are processed within a fully compliant regulatory environment, recognised as such by EU supervisory authorities, correspondent banks, and institutional investors.
For institutional counterparties, European limited partners, or banking compliance teams requiring formal documentation, we provide a full AML policy summary on request.
