Client Charter & Service Commitment

Before you submit your dossier, read this page. It defines what you can expect from us, what Equitrust Group delivers on your behalf, and where the boundaries of our engagement sit. No ambiguity, no fine print discovered later.

Response Times

Every dossier submitted through this platform receives a substantive response within 48 hours on business days. Not an automated acknowledgement, an actual assessment of whether your situation is a fit for a Malta structure. If it requires more time to evaluate properly, we tell you that within the same window.

Ongoing client communications are handled the same business day where possible. We operate Monday to Friday, Central European Time. If you are based in Asia or the Americas, factor in the time difference. We do not operate a 24/7 support desk and will not imply otherwise.

Languages

Client communications are conducted in English, French, German, and Polish. English is an official language of Malta. All statutory filings with the Malta Business Registry, MFSA correspondence, and formal documentation are issued in English regardless of the client’s preferred language.

What the Engagement Covers

The formation engagement is fixed-fee and covers a defined scope. KYC processing and due diligence for all directors, shareholders, and UBOs. Company name verification and reservation with the Malta Business Registry. Preparation of the Memorandum and Articles of Association, Form K1, and Form BO1. Electronic submission via BAROS. Certificate of Incorporation. Tax Identification Number and PE number registration with the Office of the Commissioner for Revenue. VAT registration where applicable. Registered office provision. Bank account introduction to the right institution or EMI provider for your profile.

If your activity requires a sector licence, whether MGA for iGaming, MFSA for fintech or e-money, or a VFA Agent-supported application for crypto-asset services, that process is scoped and priced as a separate engagement before any work begins. Licensing is never bundled silently into a formation fee.

Annual administration is a separate recurring engagement. It covers company secretarial services, annual return filing with the MBR within the 42-day statutory window, coordination of the statutory audit where required, and substance monitoring for holdings and IP structures. Invoiced annually in advance.

Services outside the standard scope (corporate tax return filing, VAT compliance, payroll, share capital changes, director appointments and resignations, powers of attorney, and the preparation and submission of 6/7ths shareholder refund claims) are invoiced separately as they arise. Time-based work is billed at a defined hourly rate by seniority level. All third-party costs, including MBR government fees, notarisation, apostille, and bank charges, are passed through at cost with no markup.

What Is Not Included

We do not provide personal tax advice in your home jurisdiction. A Malta company solves a Maltese corporate tax problem. What that structure means for your personal tax position in the UK, France, Germany, or anywhere else requires a qualified adviser in that jurisdiction. We flag when that advice is needed. We do not substitute for it.

We do not provide legal representation in foreign courts, litigation support, or immigration advice. We do not take on activities outside what has been agreed in writing at onboarding. If a request falls outside that scope, we confirm it clearly and agree the terms of any additional engagement before work begins.

Fees and Payment Terms

Formation fees are payable in advance before work commences. Annual administration fees are invoiced at the start of each service year and are non-refundable once the period has begun. Additional service fees are invoiced at project completion or quarterly in arrears. A deposit may be required for engagements outside the standard formation scope.

If your situation is more complex than a standard formation, we identify that during the initial 48-hour assessment. Any additional costs are confirmed in writing before we proceed. You will not encounter a charge that was not discussed and agreed in advance.

Invoices are due on receipt. Full fee information is available on our Fees page.

Termination

Either party may end the service relationship with reasonable written notice. Fees already paid are non-refundable. Active files at the time of termination are handled according to the terms agreed at onboarding. Registered office transfers, director changes, and company dissolution are available as defined-fee services. Your corporate documents are yours. We do not create dependencies that make it difficult to leave.

The Standard We Hold Ourselves To

We assess your situation before we take it on. We confirm the scope before we invoice. We flag problems before they become yours to manage. If something falls outside what we can deliver cleanly, we say so at the assessment stage, not after the work has started.

That is not a promise. It is how this works at Malta Company Formation.
